Probate advice you can trust

Probate is the legal process that takes place after a person’s death to deal with their estate. This can include identifying who has authority to act, valuing assets and liabilities, closing accounts, settling debts and tax, dealing with property or business interests, and distributing any remaining assets.

If the deceased left a Will, the Executors named in it are responsible for administering the estate in accordance with the Will. If there is no Will, the rules of intestacy apply, determining who can act and who will inherit. We understand that these rules can be confusing, particularly at an already emotional time, and our role is to explain everything clearly so you always know where you stand.

What to expect

We will begin by meeting with you to discuss your circumstances and gather the information needed to move matters forward. The first stage is to establish the date-of-death values of all assets and liabilities. Once the estate has been accurately valued, we will advise whether an application is required for a Grant of Probate (where there is a Will) or a Grant of Letters of Administration (where there is no Will).

We will then prepare and submit the necessary applications to HM Revenue and Customs and the Probate Registry. Once the Grant has been issued, it allows the Personal Representative to collect in the estate, deal with any property, settle outstanding liabilities, and distribute the estate in accordance with the Will or the rules of intestacy. Throughout the process, we will keep you informed and provide advice tailored to your individual circumstances.
