You have a choice to nominate who will be in charge and who will receive your assets, whether that is your loved ones, friends or favourite charities. Taking a few simple steps to set out your wishes now, will provide a peace of mind for the future.

Making decisions for the future: your LPA

There are two types of LPAs; one to cover Property and Finances and one to cover Health and Personal Welfare.

A Property and Finance LPA allows your Attorneys to access your bank accounts and investments, pensions and tax accounts, selling property and paying bills. This can be used as your authority if you need assistance or in the event that you no longer have capacity.

A Health and Welfare LPA allows your Attorneys to make decisions about your health and welfare only when you lack the capacity and cannot make these decisions yourself, such as medical treatments, care plans, where you would live and how you would be looked after. It also has a specific section about Life Sustaining Treatment  so that you may direct whether your Attorneys are allowed to give or refuse life sustaining treatment on your behalf.

LPAs are used during your lifetime and will end on death unless you have specifically cancelled them.

What to Expect

Our job is to make sure that you understand all the options available to you on how your Attorneys are appointed, when they can act and giving them guidance and instructions on how you would like to be looked after.

An LPA has to be created in a specific format and in a particular order and we will guide you every step of the way.

  1. You will choose which type of LPA to create and if you are a business owner, whether a separate Business LPA is necessary too.
  2. You will nominate your Attorneys and whether it would be necessary to appoint Replacements too.
  3. You will decide how your Attorneys will act and at what point, particularly for finances.
  4. You will consider any particular guidance or instructions that would help your Attorneys
  5. You will choose your Certificate Provider (an independent person who is a professional or a personal friend who has known you for at least 2 years) who will be required to confirm that you understand the documents, their effects and that you are making them of your own free will.

The documents will need to be signed by you, your Certificate Provider and your Attorneys in a specific order and then they must be formally validated and registered with the Office of the Public Guardian so that they could be used.

You may cancel your LPA and create a new one during your lifetime as long as you have capacity to do so. Otherwise it will be valid until death.

  • Single Will with a Trust £960 (including VAT)

  • Pair of Mirror Wills with Trusts £1440 (including VAT)

  • Letter of Wishes/Reason £180 (including VAT)

  • Notice of Severance with Trust Wills £420 (including VAT)

  • Home Visit £180 (including VAT)

  • Witness to document signing £340 (within 20 miles of York) (including VAT)

  • HMLR Office Copy of property title £8.80 (including VAT)

  • HMLR submission fee £6.00 (including VAT)
